The Constitution of the United States guarantees all citizens the right
to an attorney when they're charged with a crime. When the Government
charges a citizen with a crime, it is always the burden on the Government
to prove guilt beyond a reasonable doubt before a citizen's liberty
can be taken away. Often, criminal defense lawyers are asked questions
like "how can you represent somebody charged with a crime if you
think that he did something against the law?" We will often respond
that our job is to defend not only that person's rights, but the rights
of all citizens, to ensure that our system of justice is administered
fairly to everybody, because one never knows when he or she will need
the protection of the law.
In a Supreme Court opinion concerning the rights of a criminal defendant
to hire the attorney of his choosing, Supreme Court Chief Justice John
Roberts described the role of criminal defense attorneys as succintly
as is possible. Justice Roberts, known as a conservative thinker, clearly
understands the importance of having a justice system that is fair and
level. Here are his words:
"Federal prosecutors, when they arise in Court, represent the people
of the United States. But so do defense attorneys--one at a time".
By this comment, Justice Roberts recognized that, not only do defense attorneys
represent individuals but that they also represent the citizens of the
